3 In arguing that it was the first measure, Gaupp, Ansiedlungen, pp. 317-322, showed more sensitivity to the text than did Lot, “Hospitalité,” p. 977 n. 77, when he abruptly dismissed such an idea. Like Lot and Stein (above, Chapter iv n. 11), Dopsch, Grundlagen, 1:221222, treated LBurg 54 as though it directly documented the original partition. LBurg 54. 2-3, referring to “new” abuses by Burgundians, are the best basis for concluding that an older rule of partition was revised by Gundobad. The unsatisfactory alternative is to suppose that, until Gundobad, the Burgundians were allocated houses and woods, but no terrae.
